1. Acceptance of Terms

By downloading, installing, or using Tavi AI ("the app"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the app.

2. Description of Service

Tavi AI is a language learning application for iOS that generates personalized lessons using third-party AI providers. The app provides the pedagogical structure, user interface, and learning tools. You supply the AI by connecting your own API key for OpenAI (ChatGPT), Anthropic (Claude), or Google (Gemini).

3. AI Provider Requirements

• Your Account: You must have a valid account with at least one supported AI provider (OpenAI, Anthropic, or Google) and provide your own API key.
• Your Costs: You are responsible for all costs incurred through your AI provider account. Tavi AI does not control or subsidize API usage fees charged by your AI provider.
• Their Terms: You must comply with the terms of service of your chosen AI provider. Tavi AI is not a party to your agreement with your AI provider.

4. User Responsibilities

• You are responsible for safeguarding your API keys and credentials.
• You agree not to use the app for any unlawful purpose or in violation of any applicable laws.
• You are responsible for any content you provide to the app (e.g., custom text or photos for lessons).

5. AI-Generated Content

Lesson content, vocabulary definitions, example sentences, and other educational material in Tavi AI are generated by third-party AI models, not by Tavi AI.

• Accuracy: AI-generated content may contain errors, inaccuracies, or culturally inappropriate material. Tavi AI does not guarantee the accuracy, completeness, or appropriateness of AI-generated content.
• Not Professional Advice: AI-generated lessons are for educational purposes only and should not be relied upon as professional translation or language certification.
• Content Variability: Because lessons are generated in real time, content will vary between sessions and users.

6. Subscriptions and Payments

• Free Tier: Tavi AI offers a free tier with limited functionality (1 lesson per day).
• Tavi Pro: A paid subscription ($4.99/month or $49/year) that unlocks unlimited lessons and additional features.
• Apple Processing: All payments are processed by Apple through the App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• Refunds: Refund requests must be directed to Apple through their standard refund process.

7. Intellectual Property

The Tavi AI app, including its design, code, interface, and branding (including Vern the octopus mascot), is the intellectual property of Tavi AI. You are granted a limited, non-exclusive, non-transferable license to use the app for personal, non-commercial language learning purposes.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• Tavi AI is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
• We are not liable for any costs you incur through your AI provider, including unexpected or excessive API usage charges.
• In no event shall Tavi AI's total liability exceed the amount you paid for the app in the 12 months preceding the claim.

9. Disclaimer of Warranties

We disclaim all warranties, including but not limited to:

• The accuracy or reliability of AI-generated lesson content.
• The availability or performance of third-party AI provider APIs.
• The suitability of the app for achieving any particular language learning outcome.
• Compatibility with future versions of iOS or AI provider APIs.

10. Indemnification

You agree to indemnify and hold harmless Tavi AI from any claims, damages, or expenses arising from your use of the app, your violation of these Terms, or your violation of any third-party rights (including your AI provider's terms of service).

11. Termination

You may stop using Tavi AI at any time by deleting the app. We reserve the right to modify or discontinue the app at any time without notice. Upon termination, your right to use the app ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the app after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
